Welcome to My HomeTown Contractor! By accessing or using our app, you (“User”) agree to the following Terms of Use & Disclaimer. If you do not agree to these terms, please discontinue use of the app immediately.

1. Acceptance of Terms

By using My HomeTown Contractor (the “App”), you acknowledge that you have read, understood, and agreed to be bound by these Terms of Use and Disclaimer.

2. No Endorsement & No Guarantee of Quality

My HomeTown Contractor LLC is a directory service only and does not endorse, recommend, or guarantee the work, reliability, or integrity of any contractor listed on our platform. We do not perform background checks beyond verifying basic business credentials provided by the contractor.

It is the sole responsibility of the User to research, vet, and enter into separate agreements with any contractor they choose to hire.

We do not guarantee:

  • The quality, safety, legality, or timeliness of any services provided by contractors.
  • That a listed contractor is properly licensed, insured, or bonded at the time of hire.
  • That any contractor will meet your expectations or complete work satisfactorily.

3. Limitation of Liability

Under no circumstances shall My HomeTown Contractor LLC, its owners, employees, partners, or affiliates be held liable for:

  • Any losses, damages, injuries, or disputes resulting from services rendered by a contractor found through our app.
  • Any misrepresentation, fraud, negligence, or breach of contract committed by a listed contractor.
  • Any failure of a contractor to complete work, delays, defects, or damages arising from the contractor’s services.

My HomeTown Contractor LLC is not responsible for resolving disputes between Users and contractors. Any disputes must be handled directly between the User and the contractor.

4. No Warranty

The App is provided on an “as-is” and “as available” basis. My HomeTown Contractor LLC makes no warranties, express or implied, regarding:

  • The accuracy, completeness, or reliability of contractor listings.
  • The availability or functionality of the App.
  • The outcome of hiring any contractor.

We do not guarantee that the App will be error-free, uninterrupted, or free from harmful software or security vulnerabilities.

5. User Responsibility

Users acknowledge and agree that they are solely responsible for:

  • Conducting independent research before hiring a contractor.
  • Verifying licenses, insurance, references, and work history of any contractor.
  • Negotiating and entering into agreements with contractors without reliance on My HomeTown Contractor LLC.
  • Taking proper legal action if a dispute arises with a contractor.

6. Third-Party Links & Content

The App may contain links to third-party websites or external resources. My HomeTown Contractor LLC is not responsible for the content, accuracy, or reliability of third-party websites. Clicking on third-party links is at your own risk.

7. Indemnification

By using this App, you agree to indemnify, defend, and hold harmless My HomeTown Contractor LLC, its affiliates, employees, and partners from any claims, liabilities, losses, damages, or expenses (including legal fees) arising out of:

  • Your interactions, agreements, or disputes with any contractor.
  • Your reliance on any information provided within the App.
  • Any legal action taken against a contractor listed on our platform.

8. Modifications to These Terms

We reserve the right to update or modify these Terms of Use at any time without prior notice. Continued use of the App after modifications constitutes acceptance of the updated terms.

9. Governing Law & Dispute Resolution

These Terms of Use shall be governed by the laws of the State of Iowa. Any disputes arising from or relating to these terms shall be resolved through mediation or arbitration in Linn County, Iowa before pursuing legal action.
